Construction Regulations and Trash Disposal Rules

According to the Supplemental Declarations all construction in Gaines Bend must be approved by the Gaines Bend Property Owners Association (GBPOA) or its designated committee. This is not a new requirement. In the past all leases required construction to be approved by the owners of Gaines Bend, however, it was not strictly enforced. Since that authority was passed on to the GBPOA the following guidlines were approved by the board and a permit is now required for most construction. Below you will also find specific requirements for construction. Following these "pages" you will find the regulations for garbage disposal within Gaines Bend.

II. Goals of construction permit

  • Maintain/enhance Gaines Bend property values
  • Maintain legal limits of existing covenants
  • A consistent method for evaluating new buildings, additions and renovating/remodeling
  • Cover additional costs for non-typical use of roads and subsequent deterioration/damage
  • Prevent and/or cover additional costs for non-typical Trash/Dumpster use/abuse
  • Consideration of Neighbors (during and post-construction)
  • Maintaining aesthetics and harmony throughout Gaines Bend
  • Create win-win-win for lot owner/lessee, adjacent neighbors and all of Gaines Bend

III. What type(s) of construction will require construction permit requests?

  • All assembly, new construction or teardowns of existing construction (contractor or do-it yourself) that exceeds $5,000
  • Septic System Repair

IV. Construction Criteria:

  • All Construction
    • Trash/scrap, rock, trees, brush and dirt must be handled via rolloff dumpsters approriate for the job
    • Trash/scrap, rock, trees, brush, concrete, dirt, other construction materials and dumpsters must be contained within lot owner/lessee lot lines
    • Construction scrap from do-it-yourself jobs is not allowed in Gaines Bend regular-sized dumpsters
    • Construction scrap from contractors’ work is not allowed in any Gaines Bend dumpster
    • No burning will be allowed
    • Restroom facilities must be provided for workers
    • Concrete Trucks:
      • may not dump excess concrete on Gaines Bend property without written permission from Gaines Bend Development
      • Chutes must be washed out on the job site, not on the roadside or other Gaines Bend property
    • All workers must have citizenship papers/valid green card and a driver’s license
    • All workers must operate vehicles in a safe manner, must observe posted speed limits and are authorized access to jobsite only
    • Appliances must be discarded in the proper area. The Appliance Disposal is near the pump station across from Hell’s Gate Drive. Call Gaines Bend Office (940-779-2400) for authorization to access
    • All contractor work shall be done only on weekdays from 7AM to 7PM.
    • Building Site must be cleaned up by 7:00PM on Friday evenings. This includes proper disposal of trash, scrap construction materials, trees, brush, and scrap rock
    • Lot Owner/Lessee is ultimately responsible for compliance. Thus, any non-compliance and/or damage issues will be resolved between the lot owner/lessee and the Gaines Bend POA Board of Directors
    • All work must be completed within 9 months of approval date (with the exception of brand new homes which will be allowed 12 months.) 90-day extensions will be allowed for a fee equal to ˝ of the original fee.
  • Fences – Provide recent survey and attach to request
  • Boat Docks and Walkways – Assembly, construction and/or teardowns will not be allowed on Gaines Bend property. The BRA has approved sites for this type of work. Please contact the BRA to find a location convenient for you or your builder. (Under special circumstances and with Board approval, special fees and deposits, removal/teardown of a dock may be permitted at the boat ramp near Agarita Circle.)
  • Detached Buildings/Structures:
    • BRA Septic Approval must be obtained first (where there is/are bathroom and/or kitchen facilities in plans.)
    • BRA dock permit must be obtained prior to submitting request for adding dock and/or walkway from shoreline to dock
    • ALL buildings/structures on a lot (including docks and carports)
      • should blend with natural landscape and conform in exterior construction and colors with:
        • each other
        • the existing plat of lots
      • shall comply with the existing legal covenants for that plat
    • No more than four permanent buildings will be allowed on a lot as follows:
      • main house
      • guesthouse
      • detached enclosed garage
      • storage building
      Note: Docks and Carports are excluded from “permanent” status
    • All permanent buildings
      • shall not exceed a total footprint/groundfloor square footage of 35% of the usable lot space. (Usable lot space does not include 10 feet on either side of lot.)
      • shall not exceed 35 feet in height
    • Guesthouses
      • Leasing/renting of guesthouses is not allowed
      • Must be maintained in usable condition at all times

V. What information will be collected with the request?

  • Plans (Drawings/Blueprints) of all building(s) to scale
  • Description of Exterior Construction Materials and Colors (including drawings)
  • Exact position of the building(s) on the lot--plotted on recent survey. (Any of the four permanent buildings cannot be placed within 10 feet of either side lot line.)
  • Approximate Dates for construction from beginning to end.
  • Neighbor Feedback/Input (from any and all adjacent neighbors.) Input should be sent directly to the GBPOA Architectural Committee via fax (940-779-3376) or mail (1 Gibson Drive, Graford, TX 76449)
  • Restroom facilities for workers (via porta-potties or existing facilities in home(s))
  • Rolloff dumpster(s) where applicable or explanation of how trash will be handled and/or hauled away
  • Contact Info (home, cell, office & email)
  • Contractor Contact Info (office & cell)
  • Contractor(s) signatures on request signifying these rules will be followed
  • If applicable:
    • Recent Survey for erecting of new or replacement of existing fences
    • BRA Permits for Septic/Sewer
    • BRA Permit for Dock & Walkway

VI. Fees

  • $750 for new main house
  • $750 for >60% remodel of main house
  • $375 for >60% teardown of main or guest house
  • $750 for new guesthouse
  • $300 for additions to existing main house or guesthouse
  • $300 for new builds of the following if larger than 250 square feet
    • detached, enclosed garages
    • storage buildings

VII. Committee Evaluation Process & Timelines

  • Approval Process: 30 Days Maximum
  • Completed requests will be sent to the GBPOA Architectural Committee via fax (940-779-3376) or mail (1 Gibson Drive, Graford, TX 76449. Any applicable fees will need to be mailed to GBPOA, 1 Gibson Drive, Graford, TX 76449
  • Changes to lot owner/lessees plans may be necessary in order to approve request
  • If a request is denied or changes are recommended that are not acceptable to the lot owner/lessee, he/she will be allowed to appeal to the GBPOA Board of Directors in writing or in person at a regularly scheduled GBPOA Board of Directors meeting. The decision of the GBPOA Board will be final
  • Once the request is approved, the GBPOA will notify Gaines Bend Development to issue the official laminated permit
  • Building permits will be mailed to address on record in Gaines Bend Office (or another address otherwise requested) and shall be displayed on worksite

VIII. Committee Follow Through
  • Assigned committee member will stay in contact with lot owner until completion
  • Gaines Bend Development will delete security gate code upon completion of construction

Since the office is not always open, you need to call or contact us well in advance of the time you need permits.




Sanitary Regulations

The following regulations apply only to the regular expected upkeep of a lot. These regulations do not apply to major building, reconstruction, or remodeling.

The following Sanitary Regulations have been adopted.

  1. All items disposed of in Gaines Bend shall be deposited as follows:
    • Household garbage including but not limited to food scraps, papers, cans, fish scales and guts, etc. shall be securely enclosed in plastic or paper bags and deposited in the small dumpsters.
    • Grass clippings shall be deposited at the clearly marked locations.
    • Brush shall be deposited according to any posted or oral instructions at the clearly marked location.
    • Tires must be placed in a separate area for special collection. Contact the office for instructions.
    • Any appliance containing oil, freon or other hazardous material must be deposited in a separate area for collection. Contact the office for special instructions.
    • All other items such as appliances and carpet shall be disposed of in the large roll-off dumpsters or other areas as provided for by the Gaines Bend Property Owners Association.

In order to provide for the safe and sanitary disposal of garbage and other trash, the following methods will be used to collect funds.

  1. The owner of each house (no exceptions) shall pay the yearly assessment.
  2. All contractors and/or property owners shall make arrangements to dispose of building materials in the method specified by GBPOA.
    • Such items will not be placed in the small dumpsters.
    • There will be no burning of building materials by property owners or their employees on the lots or in the pasture.

These regulations have been established for the health and benefit of the development, in accordance with the government regulations and in accordance with agreements which state that the owners shall comply with all sanitary regulations adopted by the GBPOA.
