Gaines Bend Development

Below you will find the definition for ORV, SAFETY RULES, GAINES BEND USE RULES, USE OF ORVs ON IMPROVED ROADS, and a link for a printable version of the RELEASE/WAIVER. You can print a copy of the Release/Waiver or contact the office for a copy. All individuals that ride an ORV in Gaines Bend must have a signed Release/Waiver on file in the Gaines Bend office.

Rules prepared on March 29, 2001

The term "Off Road Vehicle" or ORV is used in the following rules. This includes non-state licensed vehicles such as, 4 -wheelers, utility vehicles (i.e. Mules, Gators), and golf carts, off road motorcycles. Go carts are included in the ORV category with certain important exceptions. This does not include any state-licensed vehicles such as a four wheel drive SUV.

    Safety Rules

  1. Safety Training Course required.
  2. Safety helmet, appropriate protective clothing and equipment is required. Bathing suits are not appropriate for operating an ORV for safety purposes.
  3. No child under the age of 12 may operate an ORV.
  4. For children under age16 to operate an ORV an adult must be within sight at all times.
  5. No person under 18 may have passengers on an ORV.
  6. No operating an ORV while under the influence of alcohol.
  7. Extreme caution must be taken at all times. The ORVs must be operated safely at all times. Gaines Bend Development retains discretion over what is considered "safe".
  8. Gaines Bend Use Rules

  9. Each ORV operator must carry personal identification and proof of safety training course at all times.
  10. If an ORV operator is asked to stop by any Gaines Bend Development Employee, they must do so immediately and provide identification and information necessary.
  11. Absolutely no ORVs may be operated outside Gaines Bend Development on Gaines Bend Ranch property.
  12. ORVs must not be used to chase wildlife or cattle.
  13. Before operating any ORV, a signed agreement and release must be on file with the Gaines Bend Office for each ORV operator. The operator and a legal guardian must sign the release if the operator is a minor. Agreement packets must be requested by phone or mail in advance of ORV use. No packets will be distributed on the weekends.
  14. ORVs must not be operated within 250 ft. of a lot except for ingress and egress.
  15. ORVs cannot be operated within 250 ft. of any improvements or posted areas (i.e.boat ramps, boat storage, corrals etc.)
  16. Go carts are not to be operated on improved roads under any circumstances including ingress and egress.
  17. Each ORV must have identification that can be clearly seen that identifies what lot it is associated with.
  18. A lot owner must be present in Gaines Bend Development if any person is using an ORV from that lot.
  19. Guests will not be allowed to bring in their personal ORVs. Limited guests use of ORVs owned by the lot owner will be allowed. All rules by must be followed. (see #12 & #17)
  20. ORVs may not be operated before 9:00am or after 9:00pm or dark, which ever comes earliest.
  21. Use Of Orvs On Improved Roads

  22. The following exception to section 10 paragraph H on page10 of the Supplemental Declaration of covenants, conditions, and restrictions for Gaines Bend Subdivision was made in response to several requests at the last GBPOA general meeting:

    The Board of Directors agreed to ignore the enforcement of 4 -wheelers, utility vehicles (i.e. Mules, Gators, etc.) and golf carts driving on improved roads within Gaines Bend Development driven by:

    1. Adult licensed drivers.
    2. Licensed drivers 16-17 years old, with a parent in the vehicle.

This would enable adults to use this type of vehicle to travel between lots, haul trash and do other odd jobs. In no way should this be interpreted to allow minor age children use of these vehicles on the improved roads.

A maximum speed limit of 20 mph must be observed at all times. All ORVs used on improved roads must yield the right of way to licensed vehicles.
